Mono Tennis Club Waiver and Release of Liability
Assumption of Risk and Indemnity Agreement

In consideration of the Mono Tennis Club accepting my application for membership and participation in the Club:

I, being a member of the Mono Tennis Club, hereby for myself, my personal representatives, heirs and next of kin (hereinafter defined as the ‘Releasors’) agree to release, waive, and discharge the Mono Tennis Club, its officers, members, employees and volunteers (hereinafter defined as the ‘Releasees’) from all liability to me, my personal representatives, assigns, heirs and next of kin for any and all loss or damage, and any claims or demands therefore on account of injury to my person or property or resulting in my death, now and forever, arising out of or from participation in the said Mono Tennis Club or any of its related activities that may occur, whether caused by the negligence of the Releasees or otherwise. 

Further, I hereby assume full responsibility for any risk of bodily injury, death or property damage, now and forever to the Releasors, arising out of or related to my participation in the Mono Tennis Club or any of its related activities, whether foreseen or unforeseen, and whether caused by the negligence of the Releasees or otherwise. 

I hereby separately agree to indemnify and save harmless the Releasees from any loss, liability, damage or cost that they may incur, now and forever, arising out of or related to participation in the said Mono Tennis Club or any of its related activities, whether caused by the negligence of the Releasees or otherwise.

I agree that this Waiver and Release of Liability, Assumption of Risk and Indemnity Agreement extends to all acts of negligence by the Releasees and is intended to be as broad and inclusive as permitted by the laws of the Province of Ontario, and that if any portion thereof is held to be invalid it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.
